Draft Bill for an Organized Fentanyl Response
House Bill ____ to amend Section 7036 subsection (a) of H.R. 2882, Public Law 118-47 under the title “Countering the flow of fentanyl and other synthetic drugs”
Provided further, delete Section 7036(c), Section 7036(c)(1) and Section 7036(c)(2) “Counter Fentanyl Coordination” The Secretary of State shall designate an existing senior official of the Department of State at the rank of Deputy Assistant Secretary or above to coordinate counter fentanyl efforts, whose responsibilities shall include—
(1) ensuring that funds made available pursuant to subsection (a) are implemented in a targeted and effective manner, including by providing policy guidance and coordination; and
(2) coordinating diplomatic engagement and other activities with the heads of other relevant Federal agencies and domestic and international stakeholders.
Provided further, replace Section 7036(c), Section 7036(c)(1) and Section 7036(c)(2) with the following:
Section 7036(c)(1) “Counter Fentanyl Coordination” The Comptroller General of the United States will report to the House Committee on Appropriations and the Senate Committee on Appropriations within 90 days:
(1) Whether all funds appropriated to countering fentanyl are coordinated from a single Federal organization using a single database available to all Federal organizations and domestic and international stakeholders countering fentanyl;
(2) Whether there are duplication of missions, charters, goals, enforcement, other areas, and activities among the heads of other relevant Federal agencies and domestic and international stakeholders;
(3) Recommend how Federal organizations and domestic and international stakeholders countering fentanyl should be organized to—
(a) to stop the flow of fentanyl, fentanyl precursors, and other synthetic drugs from countries like the PRC to other countries
(b) reduce the amount of fentanyl arriving at the United States border;
(b) dismantle and hold accountable transnational criminal organizations;
(c) support joint counternarcotics operations and intelligence sharing with United States
counterparts; and
(d) respect extradition requests for criminals sought by the United States
Provided further, amend Section 7036(d)(1) to include language the Secretary will recommend financial, economic, and other sanctions on the PRC if the Secretary concludes the PRC is not taking concrete and measurable steps to stop the flow of fentanyl, fentanyl precursors, and other synthetic drugs from the PRC to other countries.
Provided further, amend Section 7036(d)(2) to include language the Secretary will recommend financial, economic, and other sanctions on Mexico if the Secretary concludes Mexico is not using strategically aligned assistance to address the proliferation of fentanyl, fentanyl precursors, and other synthetic drugs from Mexico to the United States.
Provided further, amend Section 7045(3)(h) to delete the number “15” and replace with “100” as the percent under title IV of this Act to withhold from obligation to Mexico until the Secretary of State certifies and reports to the appropriate congressional committees that the Government of Mexico has taken steps to—
(1) reduce the amount of fentanyl arriving at the United States-Mexico border;
(2) dismantle and hold accountable transnational criminal organizations;
(3) support joint counternarcotics operations and intelligence sharing with United States counterparts; and
(4) respect extradition requests for criminals sought by the United States.
